Terms of Use

1. Scope and Provider
These Terms of Use govern the use of the Fishfy mobile app (the “App”). Provider:

By installing and using the App, you accept these terms.
2. What Fishfy Is and Is Not
Fishfy is a fishing app that calculates activity forecasts and tactical recommendations for freshwater fishing in Central Europe based on weather, water-level, and location data.
Fishfy is a decision aid, not a guarantee of success. Forecasts, tactics, and other recommendations do not replace on-site observation or professional advice.
Fishfy is not a reservation, brokerage, or booking platform. The Pro feature “Spot Occupied” does not establish any claim to a fishing spot (see section 7).
3. Requirements
To use the App you need:
• an iPhone with a supported iOS version,
• an Apple account and access to the App Store,
• an internet connection from time to time (for weather, water level, account, and cloud features).
Account, cloud, and push features additionally require a Fishfy account.
Fishfy is designed for people who go fishing on their own. If you are a minor, the consent of your legal guardian is required for an account and for Pro subscriptions.
4. Account
Sign-in is via “Sign in with Apple”, “Sign in with Google”, or an email address. You choose a public username during registration.
During account creation you can also opt in to the newsletter (“News & Updates”). This option is disabled by default. You can change it at any time in the app.
Service emails (password reset, email verification, security-related notices) are sent regardless, as they are necessary for account management.
The username chosen during account creation cannot currently be changed in the app.
You are responsible for keeping your sign-in credentials confidential.
5. Permitted and Prohibited Use
Permitted:
• Private use of the App and its features.
• Professional use as a tool when fishing.
Not permitted:
• Commercial exploitation of the App itself (sale, rental, sublicensing, redistribution).
• Bypassing technical safeguards (e.g. Pro lock, device limit, time-manipulation protection).
• Attacks on the functionality of the App, its servers, or other users.
• Use via VPN, simulator, or comparable means to manipulate Pro features such as “Spot Occupied”.
• Violation of applicable law or third-party rights.
6. Pro Subscription
Pro features are available via a subscription in the Apple App Store. Monthly and yearly plans are offered.
• Apple is the contractual partner for payment. Prices and payment terms are displayed in the App Store.
• The subscription renews automatically for the chosen period unless cancelled at least 24 hours before the end of the current period.
• If a free trial is offered, it applies only to new subscribers and only once per subscription group. Unless cancelled at least 24 hours before the trial ends, it automatically turns into a paid subscription. Any unused part of a trial is forfeited when a paid subscription is purchased.
• Cancellation and management are exclusively handled in your Apple ID settings under “Subscriptions”.
• When a Pro subscription ends, Pro features are disabled. Local data remains. Cloud-synced content may be removed after a transition period.
• Price guarantee: as long as your Pro subscription stays active and you do not cancel, the subscription price shown when you subscribed applies to future renewals, even if the App Store price for new subscribers increases later. Excluded are price changes Apple makes independently of us.
7. Pro Features You Should Know About
3-device limit:
A maximum of three devices may be active per account at the same time. When the limit is reached, you must release a device in account settings before adding a new one. Devices inactive for 60 days are automatically removed.
“Spot Occupied”:
This feature signals to other Pro users that you are currently fishing at a spot, purely as a visibility hint. It does not establish any claim to exclusivity, reservation, or actual availability of a fishing spot. Indications may be delayed or inaccurate due to location accuracy, permissions, network availability, or operating-system behaviour.
Content transfer:
You can transfer your own catches and spots to other Fishfy users. Transferred content becomes the recipient’s property.
Further Pro features include: push notifications, cloud sync, PDF export, wind and weather map, alternative baits, live spot occupancy on the map, historical catch import.
8. Your Content
Your content (catches, spots, photos, notes) belongs to you. You grant us no rights to it, except:
• to provide app features, in particular cloud sync and content transfer;
• if you opt in to voluntary data sharing (see Privacy Policy section 10): for internal analysis, with image use as described there.
You are responsible for ensuring that your content does not infringe third-party rights (in particular personality and copyright).
9. Fishing Law, Personal Responsibility
You alone are responsible for complying with applicable rules on site, in particular:
• fishing licence, permits, day tickets,
• closed seasons, minimum sizes, catch limits,
• bait and method restrictions,
• access rights, restricted zones, water regulations.
Content, forecasts, scores, and tactics in the App do not replace official or club rules or legally binding information. The applicable local regulations always prevail.
10. Safe Use of the App
Fishfy is an information and planning app. It is not intended for activities that require your undivided attention.
Do not use while:
• operating watercraft, road vehicles or aircraft,
• wading in flowing waters, on steep banks or on ice,
• in situations where distraction could endanger your safety or that of others.
You are solely responsible for your safety on and in the water. Always observe applicable traffic, navigation and safety rules, local weather and water conditions, and your own physical condition.
Fishfy does not replace official weather warnings, water-level warning systems, nautical charts or safety equipment.
11. Force Majeure
We are not liable for delays, restrictions or outages of the app caused by force majeure. This includes in particular:
• natural disasters, extreme weather events, pandemics,
• war, terrorism, government measures,
• outages of power, mobile networks or the internet,
• outages at third-party providers (e.g. Apple, Firebase, Open-Meteo, Resend, Vercel),
• strikes, sabotage, third-party cyberattacks.
During such events our obligations to provide the app are suspended. We will inform you appropriately as soon as we are able to.
12. Availability, Updates, Termination
• We reserve the right to extend, change, or discontinue the App and individual features.
• Maintenance may temporarily limit availability.
• We may suspend or terminate your account if you violate these terms, in particular in case of misuse or manipulation.
• You can terminate your account at any time via “Delete app & Firebase account” in app settings.
13. Liability
We are liable without limitation:
• for intent and gross negligence,
• for damage to life, body, or health,
• under the German Product Liability Act,
• within the scope of any guarantee we have assumed.
For simple negligence we are liable only for breach of an essential contractual duty, the fulfilment of which is necessary for the proper execution of the contract and on whose compliance you may regularly rely. In such cases, liability is limited to the foreseeable damage typical for the contract.
In particular, we assume no liability for:
• accuracy, completeness, or timeliness of weather, water-level, and forecast data,
• damage caused by faulty implementation of recommendations,
• damage caused by weather, water conditions, accessing bank areas, or personal circumstances,
• damage caused by use of the app during activities requiring undivided attention (see section 10),
• damage caused by misjudging or disregarding local weather, water or safety conditions,
• damage caused by following or not following push notifications or other in-app hints,
• damage caused by outages of third-party services (see section 11),
• damage arising from use of “Spot Occupied” (see section 7).
Mandatory consumer rights remain unaffected.
14. Copyright and Trademarks
All content of the App, texts, graphics, logos, software, is protected by copyright. “Fishfy” is a trademark of Apzura. With the download you receive a simple, non-transferable right to use the App privately; any further use requires our written consent.
15. Privacy
Which data is processed for which purpose is described in our Privacy Policy.
16. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution:

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
17. Applicable Law and Jurisdiction
German law applies, unless mandatory consumer protection provisions of the country in which you have your habitual residence provide otherwise.
Jurisdiction, to the extent legally permissible, is the registered office of the provider.
18. Final Provisions
If individual provisions are or become invalid, the validity of the remaining provisions shall be unaffected.
We will announce changes to these terms in the app. For material changes you will be asked for explicit consent.
